New HSA Laws for 2026: Example Letters for Your Patients

Now that HSA money can be used to purchase a DPC membership, it's time to get the word out! Here are a couple example letters to send to your patients.

One thing to check before you send any of these: the law's $150/month individual threshold ($300 for two or more people) is what keeps a DPC membership from being treated as disqualifying coverage. If your membership is priced above that, talk to a CPA or tax attorney to make sure your membership is payable via HSA.

We have some excellent news! DPC memberships are now allowed to be paid using Health Savings Account funds.

It's been at least 12 years in the making. In the past, the IRS called Direct Primary Care memberships a 'health plan' and therefore not only prevented someone from using HSA dollars to pay for DPC membership, but technically even from funding an HSA account.

Regardless of your political leanings, one good aspect for us out of the One Big Beautiful Bill is that it redefines Direct Primary Care inside of that Health Savings Account law as "not a health plan" — which means you can have both a DPC membership and contribute to an HSA. That applies as long as the membership fee is $150/month or less for an individual, or $300/month or less for two or more people.

If you have an HSA account currently, we highly recommend you switch over to pay for membership out of that account, as it helps take advantage of that pre-tax money. Just give us a call and we'll make sure that payment gets switched over!

If you don't have an HSA account, but your employer offers a plan with an HSA, talk to your employer or their broker to see when that plan renews and if it makes sense to switch to that plan.

We wanted to make sure both you and your insurance advisor are aware of a law that took effect January 1, 2026.

Whether you knew it or not, members that had a DPC membership were previously not allowed to have (or fund) an HSA account, let alone use those dollars to purchase a DPC membership.

That has changed. DPC memberships can now be purchased using HSA dollars, as long as the membership fee is $150/month or less for an individual, or $300/month or less for two or more people in a family.

If you currently purchase membership for your employees, we recommend you continue with that setup, as this offers you a greater discount on membership at our clinic and saves you on any administrative fees that may be passed through HSA accounts.

The biggest change is that you can now consider offering a health plan that utilizes a Health Savings Account for your employees.
